Vendor Terms, Conditions & Market Policies (2026)

These Terms and Conditions apply to all vendors participating in the Penticton Night Market at Gyro Park in Penticton, British Columbia. By submitting a vendor application and/or accepting a vendor space, you agree to the following policies.

1. Market Overview

The Penticton Night Market is a curated outdoor evening market held at Gyro Park in downtown Penticton beside Okanagan Lake. The event features retail vendors, food vendors, live entertainment, community programming, and volunteer support as part of the Sunset Social Club summer series.

The 2026 season runs from the first Thursday in May through the second Thursday in September. The season includes seventeen scheduled market dates. Markets take place every Thursday evening.

Markets do not operate during Peachfest week or Peach City Beach Cruise week. Those dates have already been excluded from the season schedule.

Market hours are 5:30 PM to 9:30 PM. Vendor setup occurs between 4:00 PM and 5:30 PM. Vendor takedown occurs between 9:30 PM and 11:00 PM.

All vendors must be fully set up before 5:30 PM and ready to operate when the market opens. Vendors must remain open and operating for the full duration of the market.

.2. Market Curation

The Penticton Night Market operates as a curated market. Applications are reviewed to maintain a balanced and high quality mix of vendors, food vendors, entertainment, and experiences.

Applications are evaluated based on product quality, originality, category balance, vendor presentation, operational readiness, and overall market mix.

Submission of an application does not guarantee acceptance. The market organizer reserves the right to accept, decline, or waitlist any applicant in order to maintain market quality and balance.

3. Vendor Categories

The market accepts a range of vendors including handmade goods, artisan products, curated retail, vintage goods, packaged specialty foods, services, and select resellers.

MLM businesses and direct sales organizations are not permitted.

Vendors must accurately represent the products they intend to sell during the application process. Only products listed and approved in the application are permitted to be sold at the market.

Vendors wishing to add additional products after acceptance must obtain written approval from the organizer before offering those items for sale.

4. Vendor Category Balance

The market does not grant product exclusivity. Multiple vendors offering similar or related products may be accepted in order to maintain a balanced and competitive marketplace.

Vendor acceptance is based on overall market composition and visitor experience rather than exclusivity within a category. Complaints regarding vendor competition will not result in removal of another vendor.

5. Vendor Spaces and Setup

Vendor spaces may include a 10x10 booth, 10x20 booth, food vendor tent space, cart space, or food truck or trailer space.

Vendors are responsible for providing their own equipment including a commercial-grade tent where applicable, tables, displays, lighting, and signage.

All vendor tents must be secured with a minimum of thirty pounds of weight on each leg. Unweighted tents are not permitted. Vendors who arrive without proper tent weights will be required to secure their tent immediately or remove the tent for safety reasons.

Booth placement is assigned by the market organizer. Vendors may request placement preferences, including premium placement upgrades, but placement is not guaranteed. The organizer reserves the right to adjust vendor placement at any time for operational or safety reasons.

6. Season Vendors

Season vendors reserve their space for the full seventeen market dates. Season vendor fees cover participation in the entire season regardless of attendance.

Missed markets do not qualify for refunds, credits, or fee adjustments.

Season vendors typically receive priority placement within the market layout due to their full-season commitment.

7. Drop-In Vendors

Drop-in vendors apply for individual market dates only. Acceptance is based on product fit, category balance, and available space.

Drop-in vendors must submit full payment within forty-eight hours of acceptance. Vendor dates are not confirmed until payment has been received.

Failure to submit payment within forty-eight hours results in the vendor space being released and offered to another applicant.

8. Vendor Fees and Payment

All accepted vendors must submit payment within forty-eight hours of acceptance. Vendor spaces are not confirmed until payment has been received.

If payment is not received within forty-eight hours, the vendor space will be released and offered to another applicant without further notice.

Payment methods include Interac e-transfer or credit card through a secure payment link. All vendor fees are subject to applicable taxes where required.

All accepted vendors are required to pay a one-time twenty dollar vendor onboarding fee which covers administrative onboarding and vendor coordination for the season.

9. Refunds and Transfers

Vendor fees are non-refundable and non-transferable. Vendor spaces cannot be transferred, resold, subleased, or shared with another business without written approval from the market organizer.

Missed markets do not qualify for refunds or credits.

10. Attendance Requirements

Vendors must provide a minimum of seventy-two hours notice if they cannot attend a scheduled market date.

Failure to provide notice is recorded as a no-show. Repeated no-shows may result in removal from the vendor roster and loss of eligibility for future participation.

11. Late Arrival

Vendor setup occurs between 4:00 PM and 5:30 PM. Vendors arriving after 5:30 PM will not be permitted to enter the market if pedestrian traffic prevents safe vehicle access.

Late arrival results in loss of that market date without refund.

12. Early Breakdown

Vendors must remain open until 9:30 PM. Early breakdown is not permitted.

Vendors who pack up early without organizer approval may lose priority placement or eligibility for future markets.

13. Electrical Power

Electrical access at the market is limited and must be requested during the application process.

Vendors approved for electrical service must supply their own commercial-grade extension cords and connectors. All cords must be outdoor-rated, grounded, and in good working condition.

Electrical cables must be routed and secured safely so that they do not create hazards for the public.

The market does not provide adapters, additional cabling, or power distribution equipment.

Vendors must not exceed the approved electrical capacity assigned to their booth. Vendors drawing excessive power may be disconnected from electrical service for safety reasons.

14. Food Vendor Requirements

Food vendors must comply with all applicable regulations including Interior Health requirements, municipal regulations, and any required operating permits.

Food vendors must provide valid Food Safe certification and proof of Interior Health approval prior to participation.

Food vendors must carry a minimum of three million dollars in liability insurance and provide proof of insurance before opening night.

15. Propane, Fire Safety, and Inspections

Food vendors using propane or open flame cooking equipment must comply with all fire safety regulations required by the City of Penticton and the Penticton Fire Department.

All propane tanks must be secured and connected using approved regulators and hoses. All cooking equipment must be maintained in safe working condition.

Food vendors must maintain an appropriate fire extinguisher rated for grease and cooking fires within immediate reach of cooking equipment.

Fire extinguishers must be properly serviced and inspected.

Food vendors may be subject to inspection by fire officials before or during the event. Vendors must comply with any direction provided by fire officials.

Where required by municipal regulation, vendors must display a valid fire inspection approval decal or permit issued by the appropriate authority.

Failure to comply with fire safety requirements will result in immediate shutdown of the vendor operation until compliance is achieved.

16. Vendor Conduct

Vendors must maintain a professional and respectful environment for visitors, staff, volunteers, and other vendors.

Aggressive sales tactics, harassment, disruptive behavior, unauthorized amplification, selling unapproved products, or damaging park property are not permitted.

Vendors who violate market policies may be removed from the event.

17. Live Entertainment and Performers

Live entertainment is curated as part of the Sunset Social Club programming.

Performances generally occur between 6:00 PM and 9:00 PM during the market.

Performers may be scheduled for one or two forty-five minute sets depending on programming needs.

Performers must provide their own instruments and equipment unless otherwise arranged with the organizer.

Performers must maintain appropriate sound levels suitable for an outdoor public event and follow all direction from the organizer regarding equipment placement or volume levels.

18. Busker Program

The market may feature rotating busker performances. Buskers perform in designated locations assigned by the organizer and must follow all event guidelines and safety requirements.

19. Volunteers

Volunteers support the operation of the market including vendor check-in, information tent operations, logistics support, event setup, and community programming.

Volunteers must attend confirmed shifts or provide reasonable notice if unavailable.

Volunteers must maintain a respectful and positive attitude while representing the event.

20. Insurance and Liability

All vendors must carry a minimum of three million dollars in liability insurance and provide proof of coverage prior to participation.

Participation in the Penticton Night Market occurs at the participant’s own risk.

The Penticton Night Market, its organizers, staff, partners, volunteers, and the City of Penticton are not responsible for loss, theft, injury, or damage to vendor property, equipment, or merchandise.

21. Photography and Promotion

The event will be photographed and recorded for promotional purposes.

By participating in the market, vendors, performers, and volunteers grant permission for images, video, and audio recordings to be used in promotional materials for the Penticton Night Market and Sunset Social Club.

22. Policy Updates

The Penticton Night Market reserves the right to update event policies when necessary. Participants will be notified of any significant policy changes.

23. Agreement

By submitting an application and accepting participation in the Penticton Night Market, vendors, food vendors, performers, and volunteers confirm that they have read, understood, and agree to comply with these Terms, Conditions, and Event Policies.

24. Rain or Shine

The Penticton Night Market operates rain or shine. Markets will proceed in most weather conditions unless weather or environmental factors are deemed unsafe by the organizer, the City of Penticton, or relevant authorities.

Vendor fees are non-refundable due to weather conditions, including heat, rain, wind, smoke, or air quality advisories, unless the event is cancelled by the organizer for safety reasons.

25. Unforeseen Circumstances

The Penticton Night Market reserves the right to modify, postpone, or cancel any market date or aspect of the event due to circumstances beyond reasonable control. These circumstances may include, but are not limited to, extreme weather, wildfire smoke, public health orders, municipal requirements, safety concerns, emergency situations, or other unforeseen conditions.

The organizer will make reasonable efforts to communicate changes as early as possible.

26. Sound and Amplification

Music, amplification, or audio devices at vendor booths are not permitted unless approved in advance by the organizer. Sound levels must remain appropriate for a shared public environment and must not interfere with live entertainment, neighbouring vendors, or visitor experience.

The organizer reserves the right to request volume adjustments or discontinuation of sound at any time.

27. Signage and Display Standards

Vendor displays and signage must be professional in appearance and consistent with the quality of a curated market environment. Signage must not obstruct walkways, neighbouring booths, or public sightlines.

Displays must be stable, safe, and contained within the assigned booth space.

28. Product Compliance

Vendors are responsible for ensuring that all products comply with applicable laws and regulations, including labeling, packaging, safety, and consumer protection requirements where applicable.

The organizer reserves the right to request removal of any product that does not meet regulatory requirements or market standards.

29. Booth Sharing

Vendor spaces may not be shared, subleased, transferred, or reassigned to another business without prior written approval from the organizer.

Only the business approved through the application process may operate within the assigned booth space.

30. Compliance with Event Direction

Vendors, participants, and staff must follow direction provided by event staff, volunteers, security personnel, municipal representatives, and emergency services.

Failure to comply with safety direction may result in removal from the event without refund.

31. Cleanliness and Waste

Vendors are responsible for maintaining a clean, tidy, and safe booth space throughout the event. Vendors must remove all materials, garbage, and recycling at the end of each market date.

Wastewater, food waste, packaging, and product materials must be disposed of responsibly and may not be left in the park or surrounding areas.

32. Presentation Standards

The Penticton Night Market is a curated event that prioritizes quality presentation and visitor experience. Vendors are encouraged to maintain visually appealing displays that reflect the overall atmosphere of the market.

The organizer reserves the right to request reasonable adjustments to booth presentation where necessary to maintain market standards.
